Terms & Conditions of Use

These Terms & Conditions ("Terms") govern your access to and use of the CrapApp application and services (the "Service"). By checking the agreement box, creating an account, or using the Service, you agree to be bound by these Terms. If you do not agree, do not create an account or use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use the Service. By registering you represent and warrant that you meet this requirement.

2. Accounts & Registration

You must register for an account and affirmatively agree to these Terms and the Privacy Policy before using the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate and current information.

3. Description of the Service

CrapApp allows users to locate public restrooms, obtain directions, and submit photographs that are automatically evaluated by an artificial-intelligence system and scored for cleanliness. Only the most recent photograph and score for each location are displayed; historical photographs are not retained.

4. User Conduct & Prohibited Content

You agree to use the Service lawfully and responsibly. You will not submit, upload, or transmit any content that:

contains any human being, human face, or any part of the human body;
contains any animal;
is obscene, pornographic, sexually explicit, lewd, or otherwise indecent;
is unlawful, harassing, defamatory, hateful, threatening, or invasive of another person’s privacy;
depicts anything other than a genuine public restroom facility;
infringes any intellectual-property, privacy, or other right of any party; or
contains malware or attempts to disrupt or interfere with the Service.

The Service is intended solely for photographs of restroom facilities. The express intent of these Terms is to keep the Service safe and free from the photographing of human beings and animals alike. Violations may be reported to the appropriate authorities and prosecuted to the fullest extent permitted by law.

5. Automated Screening

Photographs you submit are automatically screened by an AI system that rejects images in which a human appears and images that are not restrooms. This screening is provided on a best-efforts basis, may not catch every violation, and does not relieve you of your obligation to comply with these Terms.

6. Ownership & Confidentiality of Data

All data, photographs, ratings, and other content collected through the Service are the sole and exclusive property of CrapApp and are held confidentially by CrapApp. By submitting content, you irrevocably assign to CrapApp all right, title, and interest in and to that content, and, to the extent permitted by law, waive any moral rights therein. CrapApp may use, store, reproduce, modify, display, and distribute such content in connection with operating and improving the Service.

7. Location Information

The Service uses your device’s location to display nearby restrooms and to verify that photographs are captured on-site. Your use of location features is subject to the Privacy Policy.

8. Moderation & Termination

CrapApp may, in its sole discretion and without prior notice, remove content, hide locations, and suspend or terminate accounts that violate these Terms or that are the subject of user reports.

9. Disclaimers

THE SERVICE AND ALL CONTENT, INCLUDING AI-GENERATED CLEANLINESS SCORES, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CrapApp does not warrant the accuracy of any score, the cleanliness, availability, or safety of any facility, or the uninterrupted operation of the Service. You rely on any information provided by the Service at your own risk.

10. Mutual Limitation of Liability

To the fullest extent permitted by law, neither party shall be liable to the other for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the Service or these Terms. The parties intend that liability under these Terms be allocated equally and reciprocally between them, and each party’s aggregate liability to the other for direct damages shall be limited to an equal, reasonable amount not to exceed the total amounts (if any) exchanged between the parties in the twelve (12) months preceding the event giving rise to the claim.

11. Mutual Indemnification

Each party agrees to indemnify and hold the other harmless from third-party claims arising out of that party’s breach of these Terms or violation of law, consistent with the equal and reciprocal allocation of liability described above.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.

13. Changes to These Terms

CrapApp may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date, and continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
